Plan Commission Meeting

Chairman DuWayne Fenner called the meeting to order at 7:35 p.m. In addition to the chairman, all of the other members of the commission, including Bryon Feller, Michael Gengler, Greg Schwartzlow and Hans Sulzer, were present.
Upon motion duly made and seconded, the commission approved the minutes of the commission, held September 13, 2010, which had been previously distributed.
The chairman then asked Mr. Gengler to report on the current status of the Public Service Commission’s wind energy rules docket, and on the draft wind energy systems ordinance that he had drafted and distributed to the members of the commission.
Mr. Gengler called the attention of the commission to a prior email that he had forwarded, containing a link to a legislative web site on which the progress of the draft PSC regulations through the legislative review process may be tracked. He advised the commission that the draft PSC regulations, previously distributed to the commission in August, were now being reviewed by the legislature. He stated that the regulations were not yet effective. He stated that the review committee in the legislature has requested changes and the PSC is considering those changes. He also stated that with the change in the governing party in the governor’s office and both houses of the legislature, it is likely that the entire subject will be reviewed again before the PSC regulations become effective.
Mr. Gengler then explained the draft town wind energy system ordinance to the commission. He stated that the town may become the first stop in the approval process by adopting an ordinance similar to the one that he has prepared and distributed to the commission. If the town does not adopt such an ordinance, the town government will have only the ability to issue a statement to the PSC or the county in the event a developer seeks to locate a wind energy system in the town. Mr. Gengler noted that the application process for a wind energy system is not especially complicated in the proposed PSC regulations, and that his ordinance is intended to be revenue neutral, because the developer would have to pay the town to process the approval application. It was the consensus of the commission that the draft ordinance should be reviewed by the members of the commission but that any action should be postponed until the PSC regulations become final and the commission knows if there will be major changes.
Mr. Gengler was asked to contact the clerk in the Lena, Illinois, area regarding possible tax issues involving the wind farm there. He also said that given more time this month he would complete the requested check of the Minnesota and Iowa policies on wind energy systems.
There were no questions of interpretation related to ordinances administered by the plan commission.
The commission decided that Mr. Fenner and Mr. Gengler should discuss whether the commission should meet in December on the basis of developments on the PSC wind energy system rules and any other possible actions that may be needed by the commission.
The commission voted to adjourn at 8:20 p.m.
