Minutes of meeting of May 11, 2009

The meeting of the Town of Mount Pleasant Plan Commission held May 11, 2009, was called to order by Chairman Hans Sulzer at 7:34 p.m. Plan Commission members Hans Sulzer, Scott Dilley, DuWayne Fenner, Michael Gengler, Jerry Klassy and Greg Schwartzlow were present. Also present were Town Chairman Sally Roe, Todd Hasse of Hasse Surveying, Frank Goodman, Michael Aerberhard and Town Counsel Dan Bartholf of Voegeli, Ewald & Bartholf.
As the first item of business, Chairman Sulzer requested the commission to consider the application of Frank Goodman for a modification of a conditional use permit for his commercial kitchen at his property on Schneeburger Road. The modification must be approved by Green County but also by the Town of Mount Pleasant. Mr. Goodman provided copies of the existing conditional use permit and of the conditional use permit as sought to be modified, together with other correspondence between him and Green County Zoning. Included in that correspondence was a letter from Kranig Excavating confirming that the septic system installed at the property, which has a capacity of 300 gpd, would have adequate capacity after allowing for the existing 45 god flow and the additional 45 gpd flow expected as a result of the modification to the conditional use permit. Mr. Goodman stated that he wants to have the conditional use permit amended to allow for retail sales off premises of food prepared in the commercial kitchen. Mr. Goodman stated that there would be no impact on traffic to and from the location, and no change in the use of the property from its current use of vacation rentals. After a discussion, upon motion duly made and seconded, the commission voted to recommend to the Board of Supervisors that the board approve Mr. Goodman’s request to modify the conditional use permit as described.
Mr. Hasse submitted copies of recorded certified survey maps related to the land divisions recently approved by the town board for the William Bittner and Frank Goodman properties.
The chairman then asked if there were any other land divisions to come before the commission. The response was negative. Mr. Aeberhard was advised that the discussion of property recently conveyed by Mary Aeberhard on Pratt Road would take place in executive session. Thereupon, Mr. Hasse, Mr. Goodman and Mr. Aeberhard left the meeting.
Chairman Sulzer then requested the commission to consider the minutes of the meeting of the commission held April 13, 2009. Upon motion duly made and seconded, the minutes were unanimously approved as presented.
At the request of Chairman Sulzer, Mr. Bartholf and Ms. Roe reported concerning proposed amendments to the Land Division and Subdivision Code and accompanying guidelines to clarify some interpretation issues that have arisen since adoption of the Code in 2006. After a discussion, it was the consensus of the commission that Mr. Gengler should meet with Mr. Bartholf and thereafter with Ms. Roe to address points raised during the discussion, and that all three should report back to the commission.
There were no other interpretation issues involving ordinances administered by the commission.
The chairman then asked the commission to go into executive session to discuss the request of the Aeberhards that a land division not be used in connection with a recent sale of land on Pratt Road by the Aeberhards. Upon motion duly made and seconded, the commission voted to go into executive session. Mr. Bartholf advised the commission concerning the Aeberhard land transfer, and the commission discussed the advice. The commission concluded that further discussion would be needed at a later date.
Upon motion duly made and seconded, the commission voted to adjourn at 9:35 p.m.
