Plan Commission Meeting

Chairman DuWayne Fenner called the meeting to order at 7:31 p.m. In addition to the chairman, all of the other members of the commission, including Bryon Feller, Michael Gengler, Greg Schwartzlow and Hans Sulzer, were present. Also present was Chris Babler-Young, who was interested in obtaining advice from the plan commission with respect to a forthcoming sale of land from her family partnership.

Upon motion duly made and seconded, the commission approved the minutes of the commission, held February 14, 2011, which had been previously distributed.

The chairman requested Mr. Gengler to report concerning the status of the Public Service Commission’s wind energy rules, which became effective December 27, 2010. Mr. Gengler advised the commission that the legislature’s Joint Committee for Review of Administrative Rules voted on March 1, 2011, to suspend the PSC rules. The legislature now has 30 days within which to pass legislation abrogating the PSC rules. It was the consensus of the commission that further action on the proposed wind energy ordinance for the town should be placed on hold until further specific rules are passed at the state level.

At the request of the chairman, Mr. Gengler next reported that a written approval from the Wisconsin Department of Natural Resources was anticipated, and that the final papers would be signed and delivered at the March 21, 2011, meeting of the town Board of Supervisors.

Next, the Chairman asked Ms. Babler-Young to explain to the commission the proposed sale of land for which advice was being requested. Ms. Babler-Young advised the commission that the Babler Investment Limited Partnership plans to sell tax parcel 301 and 304 to an adjoining landowner, Ken Risley, who currently owns tax parcel 301.1. The two parcels being sold abut Krueger Road. Ms. Babler-Young stated that as a result of the sale, tax parcel 312, which the limited partnership will continue to own, will be landlocked, but that Mr. Risley will grant the partnership an easement to access the landlocked parcel. She stated that the family hopes to close this sale on May 1, 2011. The commission considered the proposal. Mr. Gengler stated that because the sale was to an adjoining landowner, no land divisions would be used, pursuant to Section 1-3-1(a)(3) of the Town’s Land Division and Subdivision Code, which exempts transfers between adjoining landowners as long as no new lots are created. Mr. Gengler agreed to speak with Attorney Paul Voegeli, who is advising the family on this matter, and to check the number of land divisions associated with these parcels. He advised that as long as the deed excepts the land divisions from the sale, the partnership may retain the land divisions.

There were no other matters of interpretation of the ordinances administered by the Plan Commission. The chairman advised the commission that a transaction proposed by Ken Christen would probably be on next month’s agenda.

The commission voted to adjourn at 8:15 p.m.
