The meeting of the Town of Mount Pleasant Plan Commission held June 7, 2010, was called to order by Chairman DuWayne Fenner at 7:35 p.m. Plan Commission members Bryon Feller, DuWayne Fenner, Michael Gengler, Greg Schwartzlow and Hans Sulzer were present. Also present was Don Silver.

At the request of the chairman, the commission members first considered the agenda for the meeting. Upon motion duly made and seconded, the agenda was unanimously approved.

As the next item of business, the Chairman asked the members to consider the minutes of the meeting of the commission held April 12, 2010. Upon motion duly made and seconded, the minutes were unanimously approved as written.

The Chairman then requested Don Silver to explain to the commission the results of a land transfer between his family and the Plambecks, owners of land adjoining the Silver farm. Mr. Silver explained that deed descriptions had not matched historic fence lines, and that a survey and land transfer had taken place so that property boundaries now follow fence lines. Mr. Silver explained that the two areas exchanged by the adjoining landowners had been added to the adjacent parcels, so that no new lots had been created. He explained that the Plambecks had since sold the adjoining parcel in question to Don and Sally Roe. After reviewing the survey map, the commission confirmed that the transfer did not result in the use of any land divisions, because the transfer complied with Section 1-3-1(a)(3) of the town’s Land Division and Subdivision Code.

Mr. Fenner then asked Mr. Gengler to report concerning the status of the wind energy system regulations being considered by the state Public Service Commission. Mr. Gengler reported that the Public Service Commission issued proposed regulations regarding wind energy system siting on May 14, 2010. He reviewed the significant provisions of the proposed regulations with the commission. He stated that the setback requirements of a turbine from a residence not owned by the wind lessor was 3.1 times the maximum blade tip height, and from adjoining property lines was 1.1 times the maximum blade tip height. He pointed out that the corresponding setback requirements of the draft town ordinance were roughly twice those of the proposed PSC regulations. He stated that the maximum sound level requirements of the proposed regulations were equivalent to those of the town’s proposed ordinance. He pointed out that persons living within one-half mile of a wind energy installation would be eligible for annual compensation from the developer, but that such compensation up to the same amount received by the owner of land on which the turbine was located would preclude any other relief for loss of value of the adjoining land.

It was the consensus of the commission that the setback and compensation provisions of the proposed regulation noted by Mr. Gengler were not in the best interest of town residents, and recommended that the town board submit written comments to the PSC objecting to those provisions prior to the July 7, 2010, deadline.

At the request of the chairman, the commission then discussed a request from the town board to set a date at which town land owners may learn more about the Working Lands Initiative and express their views on possible adoption by Green County of an exclusive agriculture zoning classification. The commission recommended to the town board that a special meeting of the commission be held on August 23, 2010, for that purpose.

There were no land divisions or questions of interpretation of ordinances administered by the plan commission to come before the meeting.

The commission agreed that it would not meet in July but would hold its regular meeting on the second Monday of August.

Upon motion duly made and seconded, the meeting was adjourned at 8:00 p.m.
